Napster News Flash!
2001.2.12
......................................................

The Ninth Circuit Court of Appeals has ruled against Napster in our
effort to keep the major recording companies from shutting us down.
We are not shut down, but under this decision we could be. We are
very disappointed in this ruling by the three-judge panel and will
seek appellate review. The Court today ruled on the basis of what
it recognized was an incomplete record before it. We look forward
to getting more facts into the record. While we respect the Court's
decision, we believe, contrary to the Court's ruling today, that
Napster users are not copyright infringers. We will pursue every
avenue in the courts and the Congress to keep Napster operating.

Get the low-down on the ruling and check out a video clip of Shawn
Fanning and Hank Barry's comments on our legal update page:

You can do several things to help Napster stay alive. Place a
telephone call to your Representatives in Congress and take other
steps using the tools in our speakout section:

Support from the Napster Community has been the key to our success
in the past. In the coming months, we will need it more than ever.

Anyway, nothing is final with Napster yet. They've just been shut down during the trial. Most likely they will be forced to stop offering free services and pay royalties or something.

this appears when you launch napster, and all napster users have been
following the story..

there is no point in posting this, everyone knows!

ESPECIALLY NO POINT IN AN AW NG!
grr :P

Are we now assigning levels of priority to what we post in AW NG , I just
see it as another Information source , no big inconvience if its something I
don't find interesting ,perhaps I'm wrong in thinking so , but I'm sure
people will tell me about it .

[View Quote] with napigator you can select servers other than the official napster
ones... even if the official napster servers get shut down, those will
probably stay up. For a while at least.

If you have no association with Napster, then why are you looking around for
information on it? We ARE an Activeworlds newsgroup, not a Napster
newsgroup. If you want Napster info, go to a Napster newsgroup. It's as
simple as that.

No need for posts like these, especially when everyone who needs to know
what happened does. Posts like these keeps the newsgroups inefficient and
lets other new users think that this might be okay, which is isn't. It's not
community related, well, not the AW community. :) My advice is watch a news
source. :)

Yes, it would be preferable it if things were kept on-topic in here...

Hmmm.. Actually this is on topic in relation to Napster's outcome
through the courts. Only in one respect. AW 3.1 supports the download
of MP3's to be played via the browser. How long before that is taken
away if Napster loses the battle??

So, by supporting Napster, you will also be keeping the highway clear of
legal pot holes.

Facter, I don't mean to step on your toes or anything, but as a citizen
of AW, I do have a right to speak my opinion, nothing personal. ;)

While AW 3.1 can play MP3s, it can't stream them. This means a substantial wait for those with slower connections when trying to play large files.

True true, but when of course I am downloading them off my server it takes
approxmately 0.01 seconds to play a mp3 :D and about 1-2 minutes for anyone
on a cable modem/dsl...ahh my bot and AW 3.1 make a great mp3 player,
hohahaha!

Thanks, Bit! I just didnt know how to put it in the right words. You hit the
spot in regards to "on-topic" posting. I was a little confused as to the
reference to "on-topic" in this community newsgroup. I appreciate Facter
pointing this out, but I didnt understand how this was off-topic.

Very true. However, I doubt the music industry is going to want to even set
foot on software apps that don't focus on MP3s. Because you see, they'd need
to deal with the likes of Electronic Arts so they don't look like they're
picking on the little guys (Napster Inc. and any other small software
developer that crosses them). Capital Records vs. Electronic Arts... Now
THERES a fight to the death.

Well, the point of mp3s were never to use it to play music, but to replace
wav files. :)

That's one of those tactics to keep mp3s down to less than a mb so everyone
can use it. :) Which means, any decent mp3 would only be a welcome message
or to replace wavs. :)
